Terms of service
1. Who we are
This shop at shop.beyondthetypical.org (the "Shop") is run by Beyond Typical, a California nonprofit public benefit corporation (501(c)(3) status pending), EIN 43-2235528, 5085 5th Street, Rocklin, CA 95677. "We," "us," and "our" mean Beyond Typical. You can reach us at renee@beyondthetypical.org.
2. Agreeing to these terms
By browsing the Shop or placing an order, you agree to these Terms of Service and to the policies they link to: our Return & Refund Policy, Shipping Policy, and Privacy Policy. If you don't agree, please don't use the Shop. You must be at least 18 years old, or the age of majority where you live, to place an order.
3. Our products and suppliers
Many of our products come from independent suppliers through Shopify Collective. These suppliers make or source the products and ship them to you directly.
- Product information. Product descriptions, sizes, and photos come from our suppliers. We work to keep them accurate, but colors can look different on different screens, and suppliers sometimes change their products. If something doesn't match what you expected, our Return & Refund Policy explains your options.
- Safety and use. Please read and follow each product's age guidance, size information, and safety warnings, and supervise children during use. Our products are general consumer goods. They aren't medical devices and aren't meant to diagnose, treat, or cure any condition. For questions about your child's specific needs, please talk with your child's care team.
- Availability. Products may sell out or be discontinued at any time.
4. Orders, prices, and payment
- Prices are in US dollars. Applicable taxes and shipping are added at checkout.
- We may refuse or cancel an order, or limit quantities. Reasons include a product being unavailable, an obvious pricing or listing error, or a suspected fraudulent order. If we cancel an order you've already paid for, we'll refund you in full.
- Payments are processed securely by Shopify and its payment partners. We never see or store your full card number.
- Prices and products may change without notice. Your order is charged at the price shown when you placed it.
5. Purchases are not donations
Buying from the Shop is a purchase of goods, not a charitable donation, and it isn't tax-deductible. Beyond Typical's 501(c)(3) status is pending.
We plan to use 100% of the Shop's net profits to fund resources and programs for families raising children on the autism spectrum. "Net profits" means what's left after the cost of the products, shipping, payment and platform fees, and other direct costs of running the shop.
If you'd like to give directly, please visit beyondthetypical.org/donate.
6. Shipping, returns, and refunds
Shipping is covered by our Shipping Policy, and returns and refunds by our Return & Refund Policy. Items from different suppliers ship separately, and return windows vary by product.
7. Your information and accounts
Please give accurate, current information when you check out or create an account, and keep your login details private. Our Privacy Policy explains how we collect and use your information.
8. Using the Shop responsibly
Please don't use the Shop for anything unlawful. Don't interfere with its security or operation, scrape or copy it in bulk, upload harmful code, or impersonate anyone. We may suspend access for anyone who misuses the Shop.
9. Our content
The Shop's text, graphics, logos, and the Beyond Typical name belong to us or our suppliers and licensors. Please don't copy or reuse them without permission. Supplier brand names and trademarks belong to their owners.
10. Third-party services and links
The Shop runs on Shopify and uses third-party services, such as payment processors and shipping carriers. Their own terms apply to those services. We're not responsible for third-party websites we link to.
11. Warranties
Products may come with a warranty from their manufacturer or supplier. Apart from that, and to the fullest extent the law allows, the Shop and its products are provided "as is," without other warranties, express or implied. Nothing in these terms limits any rights you have under California or federal consumer protection law that can't be waived.
12. Limitation of liability
To the fullest extent the law allows, Beyond Typical isn't liable for indirect, incidental, or consequential damages arising from your use of the Shop or its products. Our total liability for any claim related to an order is limited to the amount you paid for that order. Some places don't allow these limits, so they may not apply to you.
13. Indemnity
If you break these terms or the law while using the Shop, you agree to cover reasonable losses and costs this causes Beyond Typical, to the extent the law allows.
14. Governing law
These terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Placer County, California, unless the law requires otherwise. Before filing anything, please email us first. Most problems can be solved with a quick conversation.
15. Changes to these terms
We may update these terms from time to time and will post the new version on this page with a new effective date. The terms in place when you place an order apply to that order.
16. Everything else
If any part of these terms is found unenforceable, the rest still applies. If we don't enforce a term right away, that doesn't mean we've given it up. These terms and the policies linked above are the whole agreement between you and us about the Shop.
